New Generation Instructor Courses – Terms & Conditions

These terms and conditions apply to all bookings made after the 1st July 2020, and apply to the supply of Courses, Services and Goods by New Generation Ski and Snowboard School (“New Generation”) by the client (“You”).

These terms and conditions were updated on September 28th 2021.

  1. New Generation is registered in the UK at First Floor Roxburghe House, 273-287 Regent Street, London, W1B 2HA.
  2. By making your booking you, or if You are under 18 Your parent or guardian, agree to the terms and conditions here listed. These terms apply to bookings made by telephone, email, online or by any other means.
  3. Occasionally, we make special offers. If there are inconsistencies in the offer with these General Terms, the terms of the offer override these General Terms and Conditions to the extent that they do.
  4. No variation of these terms can be made unless the variation is agreed by both parties (New Generation and You) in writing.
  5. Interpretation
    1. “BASI” refers to the British Association of Snowsports Instructor
    2. “Course” refers to the training, Services and Goods offered by New Generation as a package. The services and goods included in each Course; the price; and Course dates are clearly listed on the New Generation Instructor Courses Website.
    3. “Goods” refers any items provided to You by New Generation. What is included is clearly listed on the New Generation Instructor Courses Website.
    4. “Our Website” collectively refers to the New Generation Instructor Courses Website – https://www.instructorCourses.skinewgen.com/; and our booking portal – https://newgenbooking.com/instructors/
    5. “Personal Information” refers to information provided to New Generation by You or the Student in the Course of New Generation’s performance under this Agreement that:
      1. Identifies or can be used to identify an individual (including, without limitation, names, signatures, addresses, telephone numbers, e-mail addresses and other unique identifiers); or
      2. Can be used to authenticate an individual (including, without limitation, financial account numbers, medical information, answers to security questions and other personal identifiers).
      3. Business contact information is not by itself deemed to be Personal Information.
    6. “Residential BASI 1&2 Courses” refers to Courses which comprise of a package including accommodation, lift pass and both the BASI 1&2 examinations.
    7. “Services” means training delivered, catering supplied off-hill support provided by New Generation and Third Party Staff.
    8. “The New Generation (Team)” refers to all New Generation & third party staff, including but not restricted to: instructor Courses administrators; instructors; mentors; operational, administrative and catering staff.
    9. “The Student” refers to the person attending the Course; whether it is You the purchaser or a person You have booked on behalf of.
    10. “Third Parties” refers to all parties with which New Generation may be required to share Student information with. This may include, but is not restricted to; BASI, catering companies, accommodation providers, transfer companies, equipment providers, First Aid course providers.
  6. The Student must be 18 years or older on the first day of the booked Course.
  7. Parental consent must be obtained prior to booking if the Student is under 18 at the time of booking
  8. It is Your responsibility to keep the New Generation office informed of any change of address after booking onto a Course. This must be confirmed in writing by email or letter to the New Generation office.
  9. There will be a maximum number of 10 Students in each of the on-snow training groups.
  10. All prices quoted by New Generation orally; via our Website; and in writing are for the specified Course only, as described on our Website and/or within any promotional materials. Unless otherwise stated, You must arrange all other potential costs connected with the Course. This may include: sports equipment; medical or travel insurance; accommodation; lift passes etc.
  11. If we believe that incorrect information has been provided regarding the age or level of a client and we do not have space to move them to an appropriate course, we reserve the right to exclude them from the course without offering a refund or otherwise being liable to you.
  12. In some lessons and clinics your instructor might include some off-piste skiing away from the piste markers. Please check your insurance policy to ensure that you have adequate insurance to cover you for injuries suffered off-piste. In some off-piste-specific sessions, you will be required to wear avalanche safety equipment.
  13. Skiing and snowboarding are hazardous activities and you undertake them at your own risk. You must obtain insurance for your course. The Provider will not be responsible for death or any injury, losses or accidents, on or off snow however they may occur during courses, other than where the accident is caused by the Provider’s own negligence. Instructors will decide what they consider in their sole discretion appropriate terrain for the level of skiers or boarders in their courses. This may be on or off the piste. You must ensure that you, and everybody you book on behalf of, has insurance to cover this eventuality, or you must decline from going off-piste. If you or those for whom you have booked do so without such insurance, it will be due to your own negligence. If you or any of your party become uncomfortable, you must tell the instructor immediately so they can take immediate action to keep you safe.
  14. New Generation reserves the right to amend advertised content and dates of any Course before the start date. Any modifications will be communicated via email or letter.
  15. New Generation insists that all Students embarking upon a BASI Course take appropriate insurance which covers both cancellation and curtailment.
  16. New Generation reserves the right to alter any advertised accommodation within the advertised package requirements.

COVID CANCELLATION POLICY

We’re confident we will all enjoy a great upcoming winter season, but we also understand that there are many concerns you may have regarding travel and booking your ski instructor course. We know that travel restrictions and guidelines may change at any moment in the coming months, which is why we’ve created new flexible solutions for you.

All bookings for Winter 22.23 come with the following two New Generation guarantees as standard.

  • Financial Guarantee – 100% Refund Until September 3oth, 2022

Any bookings made for 2022.23 may be cancelled and fully refunded up until September 3oth, 2022. No questions asked.

  • Flexibility – Defer Your Booking for 24 months – At No Cost

Need to move your course? You now have the option to defer your course for up to 2 years, at no additional cost. You must let us know no later than 60 days before the start of your course. This option is non-transferable.

  • Refunds due to COVID restrictions
    • If due to COVID restrictions, we are unable to start the course, you will get a full refund.
    • If due to COVID restrictions, we are forced to stop the course after it has begun, you will receive a pro-rata refund of the course fees you have paid (e.g. if you have received 25 days of a 100-day course, you would be due a 75% refund).
    • If national borders are closed due to COVID restrictions meaning that you are unable to travel to the course, but the course can still run, we will reimburse you with any recoverable costs. We have to make payments in advance for accommodation, lift passes, exam fees and other associated costs at various different points throughout the year. Recoverable costs vary by supplier and date of cancellation. We will be working hard to secure the most flexible terms possible with each supplier. 

*Refunds and reimbursement terms do not apply if, due to testing positive for COVID or having to self-isolate, you: 

  • Cannot attend part or all of the course
  • Are prevented from leaving your country 
  • Are prevented from entering the country where your course is run

You should ensure that you have suitable personal insurance to cover you for this eventuality.

Refunds and reimbursements can be provided via the payment methods originally used, or via a non-refundable credit voucher, valid for 24 months.

STANDARD CANCELLATION POLICY TERMS

  1. All Courses require a minimum of 5 Students to run for the full Course duration. In the event that there are less than 5 Students booked New Generation will notify You to confirm the revised Course nature, duration or cancellation.
  2. New Generation reserves the right to cancel Courses at any time prior to the Course date. In this eventuality, New Generation will refund all monies paid. 
  3. Cancellation must be notified in writing (by email or letter) by You to New Generation. Verbal instructions to cancel are not accepted and will not be acted upon by New Generation.
  4. If You / the Student chooses to cancel a space on a Course or on a BASI examination You and/or the Student will be subject to our cancellation policy.
  5. In the event of cancellation by You or the Student neither the deposit or subsequent instalments paid are refundable or transferable unless otherwise stated.
  6. The cancellation request must be acknowledged in writing by New Generation.
  7. No monies will be refunded by New Generation, or on behalf of BASI, in the event of an injury sustained either before or whilst participating in the Course.

Pre-Requisites

  1. It is the Student’s responsibility to determine that they have the health and fitness that is required to ski up to 6 hours a day for 6 days a week for the duration of the Course. New Generation will not refund Students if they are unable to continue with training due to health and/or fitness levels.
  2. For safety and insurance reasons You or the Student must notify New Generation of all pre-existing medical conditions and health issues that have necessitated the need to seek medical advice.
  3. You / the Student may experience altitude sickness or face extreme temperatures and levels of humidity. If You / the Student have any respiratory or heart conditions then a confirmation of fitness to participate in the program must be obtained from a medical practitioner.
  4. All Students must have fulfilled the following prerequisites before joining the Course:
    1. Have attended an Open Day or ski with a New Generation instructor
      1. Video evidence may be accepted as an alternative/
    2. Responded timeously and properly to all correspondence with the New Generation team; and
    3. Purchased a suitable insurance policy for their Course.
  5. For residential BASI 1&2 Courses, Students must have;
    1. Provided either a cheque or transmitted a bank transfer to the value of £500 to New Generation as a security against any damages incurred to Course accommodation; and
    2. Read and signed the Learning Agreement, Code of Conduct, Complaints Policy and Chalet Damage Disclaimer documents. A copy of the Code of Conduct can be found at Supplement A.
    3. Students will be supplied with all other materials on arrival, or can obtain copies of this documentation anytime after booking by requesting this in writing from New Generation.
  6. Failure to comply with these prerequisites may lead to removal from the course and/or incur charges in line with our cancellation policy (section 9) where appropriate
  7. Some Students may require a visa to train in the country in which their Course takes place. It is Your / the Student’s responsibility to organise this. Students who are unable to obtain a visa will not be entitled to any refund of course monies paid in line with our cancellation policy (section 9).

Fees and Payment

  1. All Course invoices and resources will be sent to the postal or email address supplied during Your booking unless otherwise agreed.
  2. Prices are payable in the currency as listed on the New Generation Website. These prices are subject to change by New Generation based on applicable exchange rates at the time of payment.
  3. You are responsible for ensuring all payments reach New Generation in full, by the agreed date, and for covering all bank charges, such as exchange rate fees, associated with any payment made.
    1. Failure to meet these requirements may result in your course place being cancelled and no refund being issued.

For Residential BASI 1&2; BASI 2 Fastrack; ISIA and ISTD Courses:

  1. Course bookings will only be accepted and confirmed when accompanied by a deposit.
  2. This deposit is non-refundable and non-transferable unless otherwise stated in writing by New Generation prior to these terms being agreed / Your booking.
  3. New Generation are free to change the amount and nature of the deposit at any time
  4. New Generation will contact You after Your booking has been confirmed with a proposed payment timetable. Upon agreeing to a payment plan You agree to pay the Course fees in full
  5. The full balance of Your Course booking must be received in full by New Generation at least 2 weeks before the commencement of Your Course unless otherwise stated or agreed

For standalone BASI Courses;

  1. Payment is required in full on booking.
  2. If You / the Student arrives in resort, having not paid the balance, as detailed on the Course invoice, the Student will not be accepted onto the Course, unless otherwise agreed by New Generation in writing.
  3. New Generation reserves the right to offer tailored quotes or discounts at its discretion. You will be notified of this change in writing.

Data Protection

  1. By entering into these Terms, you agree that New Generation may use your Personal Information to contact you regarding the course and for marketing purposes. You also agree to New Generation sharing Your contact, dietary and medical information with Third Parties where required.
  2. New Generation acknowledges that in the Course of booking, organising and running instructor courses, New Generation will receive or have access to Personal Information such as contact details, medical information and banking information.
  3. In recognition of this, New Generation agrees that it shall:
    1. Keep and maintain all Personal Information in strict confidence, using such degree of care as is appropriate to avoid unauthorized access, use or disclosure
    2. Use and disclose Personal Information solely and exclusively for the purposes for which the Personal Information, or access to it, is required for the organisation of the course, and not use, sell, rent, transfer, distribute, or otherwise disclose or make available Personal Information for New Generation’s own purposes or for the benefit of anyone other than the Student; and
    3. Not, directly or indirectly, disclose Personal Information to any person other than the New Generation Team, BASI and any third parties (such as catering, transport or accommodation companies) as required for the efficacious running of the course.

BASI

  1. New Generation is a recognised BASI Business Partner. BASI are the accreditation body for ski instruction in the United Kingdom.
  2. Unless otherwise stated, BASI examinations require a minimum of 8 persons to be confirmed as running.
  3. At least 6 weeks before the examination begins, New Generation will confirm or cancel the BASI examination to You. If it is not possible to confirm 6 weeks before, New Generation will keep the Student informed verbally or in writing.
  4. Before booking, the Student must meet BASI’s pre-booking requirements. These can be found at Supplement B.
  5. As a BASI Business Partner, New Generation reserves the right to remove the Student from the examination and/or Course on behalf of BASI if:
    1. does not meet, or is not likely to meet, the minimum standard for the appropriate grade
    2. they are found to exhibit behaviour which is deemed to be inappropriate, unprofessional and/or detrimental to BASI; or
    3. they are found to be under the influence of alcohol, drugs or addictive substances, during Course contact time.
  6. New Generation on behalf of BASI is not liable for any physical or financial hardship which may be incurred whilst attending a BASI Course.
  7. Training on New Generation Courses is delivered by instructors directly employed by New Generation. Examinations on Residential BASI 1&2 Courses and BASI 2 Fastrack Courses are delivered by BASI Trainers supplied and approved by BASI under our BASI partner agreement.
  8. For Residential BASI 1&2 Courses: In the event, the Student fails either strand of their BASI Level 1 exam (technical, teaching or both), New Generation will attempt to organise a resit within the Course dates. It is not guaranteed that an exam will be available before the BASI Level 2 exam at the end of the Course. The Student will be responsible for the Level 1 resit fee. You will not be able to attend your BASI level 2 without successfully completing your BASI level 1.

Course Safety

  1. Snowsports are conducted in an open environment, resulting in mountain conditions that can change significantly from day to day. For this reason terrain access may be limited in poor conditions, with the result that not all the criteria listed for the Course is covered.
  2. Trainers and examiners reserve the right to refuse participation in elements of the Course that they deem to be dangerous or unsuitable. Any decision will be based on the individual’s skill demonstrated during the Course and in conjunction with the piste and snow conditions
  3. By agreeing to these terms You agree, that except for death or personal injury arising through the negligence of BASI, BASI shall not be liable for any loss or damage arising whether in respect of death, bodily injury, illness suffered or loss, costs or damages or expenses incurred.

Residential BASI 1&2 Course Accommodation

  1. It is the Student’s responsibility to ensure that all accommodation, transport and any other facilities provided by BASI, New Generation or their employees or agents, are treated with respect and consideration.
  2. New Generation requires a guarantee agreement (“Chalet Damage Disclaimer”) to be signed prior to the arrival of the Student by them, their parent or their guardian.
  3. New Generation and BASI will not be responsible for any damage caused by a Student or Students. Students will be held liable for any costs incurred in such a way and will agree to settle any costs immediately.

Flights, Accommodation and Transfers

  1. New Generation will clearly display what is included in each Course on their Website, but for the avoidance of doubt:
    1. New Generation does not supply flights for any Courses.
    2. New Generation does not supply any accommodation or transfers for Standalone BASI examinations.
  2. New Generation may provide You with a recommendation, introduction or referral to suitable accommodation, transfer and other such like companies, but any bookings made by You will be subject to the individual companies Terms and Conditions. New Generation is not liable for any losses suffered by You due to Third Party negligence.
  3. We strongly recommend that You do not book any flights, accommodation, transfers or lift passes until You have had confirmation (up to 6 weeks before commencement) that the Course or examination is confirmed and running unless New Generation state otherwise.

Other Course Provisions

  1. Where catering is provided, the chalet staff will provide a two-week rotating menu.
  2. In instances where individuals have specific dietary requirements and extra costs are incurred, the Student may need to cover these additional costs. New Generation will communicate this with You or the Student directly.

Operational Interruptions

  1. If the resort is open (or partly open) the services will be delivered as planned to the extent available. Our instructors will use the open areas available to them to deliver the services in a manner that ensures your safety.
  2. Interruptions in resort operations and how resorts choose to administer their businesses are completely outside of our control. Where decisions made by resorts impact the usual delivery of our services, you will not be entitled to any reimbursement, compensation or discount. Such situations may include but are not limited to the following: Technical malfunction, strike, adverse weather conditions, excess or insufficient snow cover, power failure, disease outbreak, epidemic, resort closure and/or volume restrictions on visitor numbers. Upon request, we will provide a letter to your insurer to assist you with your insurance claim. We will not be liable to you for any such event, howsoever arising.

Force Majeure

  1. In no event shall the Provider of the services be held responsible or liable for any failure or delay in the performance of its obligations where it was legally and/or physically impossible for the lessons to be performed, such as an event covered by the term ‘Act of God’ (e.g. severe weather, volcano eruption, earthquake) or events such as war, epidemic, disease control measures implemented by the ski resort, government intervention (including deleted legislation and executive orders, refusal of licence to operate for political reasons, travel restrictions), strike, criminal and/or tortious conduct on your part or any other event beyond the control of the supplier (a “Force Majeure Event”).
  2. New Generation Ski and Snowboard Ltd shall notify the other party as soon as is practicable following commencement of a Force Majeure Event.
  3. It is understood that we will use reasonable efforts which are consistent with accepted practices within the snow sports industry to resume performance as soon as and if practicable in the circumstances as they exist at the time;
  4. in the event of a Force Majeure Event, and where we are unable to resume performance in time for the contract to be fulfilled, you will not be entitled to a refund.

SUPPLEMENTS

A: CLIENT CODE OF CONDUCT

  1. All persons who use our services must always act in a safe and appropriate manner, both on and off the snow. Situations can develop for the worse very quickly in mountainous environments and without any prior indication that they might happen. We reserve the right to remove and exclude anyone from lessons without warning (and without giving any reason at the time) to those who are not adhering to relevant safety guidelines and/or directions from instructors. This can be expected where you are in any way endangering yourself or others, where the experience of other participants is being adversely affected, or where physical or verbal abuse of any other person is evident or suspected, and whether or not you believe exclusion is acceptable or not. In such a circumstance you will not be entitled to any refund.
    1. Such situations may include but are not limited to the following:
    2. not adhering to the safety guidelines mentioned by the instructor and/or using your common sense to keep yourself safe;
    3. not following directions given to you by the instructor;
    4. failing to adhere to the International Ski Federation Code of Conduct – ie the 10 FIS Rules of Conduct;
    5. skiing under the influence of alcohol or any drug that may adversely affect your physical coordination or mental state;
    6. putting any other person at risk of injury and/or in danger; and not following government safety protocols.
  2. This is the Code of Conduct of New Generation Ski and Snowboard School (“New Generation”) which applies to all clients (“Trainees”) who undertake Instructor Training (“Courses”). All professional ski instructor courses run by New Generation Ski and Snowboard School are in partnership with BASI (British Association of Snowsport Instructors).

ATTENDANCE

  1. Trainees are expected to attend all on-snow and off-snow training. Any Trainee found to miss any course commitment (excluding social commitments or non-essential sessions) without a reasonable explanation will receive a yellow card.

DRESS CODE

  1. Trainees must maintain their issued jacket & pants to a professional standard. This means amongst other things, that they must be kept clean and free from rips or tears.
  2. Trainees must be presentable and wear their uniform when they are shadowing lessons with New Generation clients and when training.
  3. Trainees not in compliance with the above dress code will receive a yellow card (in accordance with section 5) and will not be permitted to participate in the training / shadowing of that day.
  4. ALCOHOL CONSUMPTION AND DRUGS
  5. Trainees must not have consumed alcohol before training. No alcohol is permitted during on-snow or off-snow training. If any Trainee is found to be showing signs of intoxication or being under the influence of alcohol during training, New Generation reserves the right to issue a yellow card and remove them from training.
  6. Any Trainee found to be in possession of or using illegal substances will immediately receive a yellow card and it will be at the discretion of the mentors and New Generation as to whether this may amount to a red card offence.
  7. Any Trainee found to be selling, trading or offering for sale illegal substances will immediately be given a red card and disciplinary action will be taken which may include but is not limited to contacting the police; contacting the Trainee’s parents; expulsion from the course.

GENERAL CONDUCT

  1. As a Trainee, you will be representing New Generation in public, including times You are shadowing lessons with our clients. You should therefore maintain professional conduct throughout the course. Any Trainee behaving unprofessionally during training on- or off-snow; or behaving in an antisocial manner anytime during the course may also be subject to a yellow card.
  2. Unprofessional and antisocial conduct includes, but is not limited to, the following:
    1. Verbal abuse of fellow Trainees, mentors, chalet staff or clients
    2. Ignoring explicit instructions of mentors, chalet staff or New Generation employees
    3. Physical violence; threatening behaviour
    4. Public statements or actions with a negative impact on the ski school including public use of obscene language
    5. Disrespectful behaviour in or damage to chalets.

YELLOW CARDS AND RED CARDS

  1. A yellow/red card may be issued by any member of the New Generation Team
  2. All yellow cards will be reported to the New Generation off-snow support.
  3. The issuing of cards will be communicated clearly to the Trainee.
  4. A yellow/red card may be issued in the case of gross misbehaviour (see section 4) of any Trainee on the course.
  5. A yellow card is issued as a first warning. At this stage New Generation may put in place procedures to help you. Amongst other things, You may be required to sign in with a mentor or New Generation member of staff each morning.
  6. A red card is issued as a final warning. It will be at the discretion of New Generation as to the course of disciplinary action to be taken: including, but not necessarily limited to; calling the Trainee’s parents/guardians (where appropriate); suspension from training; expulsion from the course – as per the terms and conditions.
  7. A Trainee receiving a maximum of 3 yellow cards will automatically receive a red card and it will be at the discretion of New Generation as to the course of disciplinary action to be taken: including, but not necessarily limited to; calling the Trainee’s parents/guardians (where appropriate); suspension from training; expulsion from the course – as per the terms and conditions.

B: BASI ASSESSMENT PREREQUISITES

Alpine Level 1 – The following prerequisites must be met before attending an Alpine Level 1 Instructor exam. Students must:

  1. Be able to ski parallel confidently, coping with a variety of conditions
  2. Be able to ski parallel on red runs, making rhythmical short turns at a steady pace
  3. Be able to ski parallel long turns on a green or easy blue slope with the skis carving the last two-thirds of the turn
  4. Be at least 16 years old
  5. It is also recommended that applicants have completed at least 16 full weeks of skiing

Alpine Level 2 – The following prerequisites must be met before attending an Alpine Level 2 Instructor exam. Students must have:

  1. Successfully completed the Alpine Level 1 Instructor Qualification
  2. The secondary 35 hours of Snowsport School Experience and submitted evidence of this no more than 5 days prior to commencement of the examination. Please refer to the BASI Website for further information.
